Alleged $6bn Fraud: EFCC Updates Charges, Presents Additional Evidence Against Agunloye

Alleged $6bn Fraud: EFCC Amends Charges Against Ex-Minister Agunloye.

The Economic and Financial Crimes Commission (EFCC) has modified the seven-count charges against former Minister of Power, Olu Agunloye, and presented additional evidence against him. Agunloye faces prosecution before Justice Jude Onwuegbuzie of the Federal Capital Territory High Court in Apo, Abuja, over allegations of official corruption and fraudulent award of the Mambilla Power Project contract worth $6 billion.

At the last court proceedings, prosecution counsel Abba Muhammad (SAN) drew attention to amendments in the charges and additional proofs of evidence filed earlier. He urged the court to allow Agunloye to take his plea considering the amendments. However, defense counsel Adeola Adedipe (SAN) objected, stating the day’s business was cross-examining the second prosecution witness, Adewale Agunbiade.

Muhammad cited Section 216(1) and (2) of the Administration of Criminal Justice Act (ACJA), asserting the prosecution’s power to amend charges at any trial stage before judgment. Adedipe argued a formal court leave is required for introducing amendments, referencing Section 218(2) of the ACJA.

Justice Onwuegbuzie ruled that the prosecution must formally apply for charge amendments, allowing defense counsel to respond on November 11, 2024.
